People just don't want to soil their hands in cleaning their house but want others to do it for them.
Lot of people consider it below dignity to do something about GC related stuff, many just want to live they way they are, no ambitions, no motivation to work towards a change.
You are right! But many others do! And many that currently don't are just misinformed, and I believe that they can have a change of heart and attend the rally once they see it is the right thing to do!

The current interpretation of spilling over to EB2 before EB3 is CORRECT. If there are three preference categories, EB1,2,3, then it is in the best national interest to maximize allocations to higher preference categories. Note that Eb3 and 4 are even lower preferences, they get only 7.1% each and NO SPILLOVERS. The preference system is in the order of EB1,2,3,4,5 - that is the law.
Is it fair to EB3 ? - NO as they have to wait much longer.
USCIS and DOS are trying hard to get all EB2 to become current asap. By doing so..
1. USCIS / DOS will look efficient (only EB3 will be backlogged)
2. 2010 onwards EB3 will get a lot more spillovers
Of course, if we have EB3 to EB2 conversions by the thousands, then the DOL - USCIS combo will clamp down on it, they will scrutinize the cases even more, slow down the processing and we will have EB2 and EB3 retrogressed for a decade.

With all due respect oldmonk the point of the thread was to get people more involved and work towards the greater good in our movement...
Not to dismiss your thoughts on this thread but lets move on and use your experience in guiding newer folks on this site in better helping our common cause.
We have seen a tremendous response to the Omnibus drive and with a collective effort we should be in a position to help the EB immigration situation.

I do not recommend Attorney Richard Prinz , Houston.
In my experience he is terribly slow, do not communicate with clients , do not pay attention to details.
His incompetence , has caused a colleague to miss the opportunity to file I485 before the retrogression kicked in july 2004 (?) and poor guy had to wait 3 years until jun 2007 to file his I485.
He hasnt filed I1485 yet ,for 2 cases from our firm, with PD current in June 07 , though the docs were provided with all the forms filled by mid june.
Once he collects the money he does not entertain any communications and says "your if u send me email or call about the case it will be further delayed".
His lack of attention caused me a denial on my I140.
I did not know abt these cases before i I had to deal with delays and denial in my own case.
He has only 2 admin assistants in the office. He still uses an aol dialup connection ,so you can imagine how updated he is.
Its frustrating when u need to be at lawyers mercy to get your case filed after paying big $$.

Hi,
My employer has filed second extension and due to the fees was not sent with the proper amount they sent back the application saying it has denied and sent an I-290B with it to apply for appeal, i just got a letter and my H1 was exp in Dec 07 please help what shall i do, i am in helpless state my employer is working but any help or info is much appreciated.

Because of the country quota what you have said below is applicable to only people from India, because of the tremendous competition from Indian applicatants you would need the highest points , ms or phd, 5 years experience, employer sponsorship, and also relatives, but if you are from non Indian countries then you will easily get it because there is not much if any competition.
For example people from India might need 90+ points to have any chance but people from other countries might need just 60 points to get in. This is not merit based system, it is Kennedy Diversity Visa disguised as merit system.
I have one question regarding your view. Actually point system gives points to the US experience and employer sponsorship. Because of limited number of greencards Those who are not having both of this may not be able to get green card. If you give your calculation everyone will get clear about. I think MS with 5 year US experience will get more points than fresh Phd. That serves the purpose. If that is the case then only eligible people will get gc.

Guys wait till you see "real" bulletin and even if mirror to what has been placed to Mumbai Consulate, EB3 will forward perhaps slowly now but picking up. EB3-India with PD 2004 mid and before will not have to worry that much.
With all these new developments I am not sure it will really move any faster. May be after october 08 we may see some considerable movement in EB3.Mine is March 03. Hope fully I will get my GC by next summer, 09 summer.

Based on Visa Bulletin report, it seems like massive retrogression is likely for EB3 as well as EB2 :( for the rest of the year. Many have ported and some hibernating applications are now active. :(
When I said that there should be one Item in IV agenda to Ban Porting, everyone got mad.
I still say that they should be allowed to port but should go back in line. they are disturbing the balance. I am not against them, if they were EB2 candidates why they didnt file on EB2 category at first, if now they think they are qualified then they should start new process.
BTW. they will create a big retrogression for EB2 then EB2 people have to port to EB3

just fyi...it took fragomen 6 months just to start the recuitment process ...they are really slow. but they are quick in getting back to you on your day to day requests.
My company started the PERM process for me about 2.5 months ago. I contacted Fragomen about 1.5 months after approvals within the company and they said they are working on establishing min requirements for the position. I then contacted them 3 weeks after that day and they said they have established the requirement and will request the DOL for prevailing wage info (this was 2 weeks ago). After which they are going to start the recruitment process. So I'm not sure if the time line is okay or should I be chasing them more frequently? Please advise.

I got approval email too. It cant be sheer luck that so many people are getting the approvals when it was taking 3 months as per their published processing times. Looks to me they just want to give 1 yr EAD to as many as possible. Good way to make money in recession year.
It was general observation that Paper Based EAD is getting approved very fast. We have quickest approval in only 18 days (http://immigrationvoice.org/forum/showthread.php?p=250677#post250677). And this was reported a month ago (on 05/23/2008).
So I think it is their speed - it has nothing to do with intention to give 1 year EAD. On the avarage, people are getting EAD in 25 days.
Myself went ahead with e-filing (this takes 50 days). My FP is scheduled after 5 weeks of notice date (http://immigrationvoice.org/forum/showthread.php?t=18737). For E-filing, they have different process,which has not changed in last two months.

What is dangerous is half knowledge. There is no such law which prohibits you from using AC-21 and doing an H-1 transfer to the new company. In fact most lawyers recommend that

I think it was mentioned in one of the posts in Murthy site that such a situation could lead to denial of I-485 as it would constitute abandonment of AOS application. One should use EAD after filling AC21.
