Based on USCIS's last action rule, the status of an applicant depends on whatever petition is approved last. So, if her H4 is approved after her H1 COS, then she will be on H4.
I am assuming you have applied for H1/H4 extension recently in regular processing. So the chances of her H1 COS getting approved first under premium are higher. So once you get her H1 COS approval, just withdraw her H4 petition.

Folks,
I am on my 6th year of H1B. My current H1 expires mid August 2009.
My PERM was filed in May 2008 and was approved in Dec 2008.
My I-140 is applied and pending. I work for an american consulting company.
Naturally, I dont have an EAD as yet.
Based on my PERM approval and 365 day rule, I know I can extend my current H1 for 1 year.
(planning to do this ASAP).
Here is my question:
- My current client contract will get terminated soon. If my current GC sponsoring company decides to terminate my employment (due to project non-availability), can i transfer my extended H1B to another employer?
In other words, is an extension H1 (7th year and beyond) similar to regular H1 (first 6 years) in regards to invoke the "transfer" rule between eligible employers? or is it tied to GC sponsoring employer?
- By doing so, do I abandon my GC application (i think i will, but general clarification) ?
Any advise would be greatly appreciated,

If your 140 is approved the chances of 485 denial are quite remote. however most attorneys recommend that you try to stay on H1 as much as possible

My company applied for my 140 (Substitute) in Premium processing (before it was stopped) and I recieved an RFE for ability to pay. Company took sometime & responded with Tax returns.
Online status says, response to RFE recieved and the processing resumed. Since mine is a PP, I epxected the result in 15 days...but its more than a month...
So I contacted my employer & he says USCIS asked for "Audited Financial statement". But online status did not change. (Still says, we recieved your response & case processing is resumed).
Is it possible that USCIS just asks for more information in reponse to RFE but still does not update the status?? What I don't understand is - normally USCIS Deny the app if they are not OK with my employer's initial response is n't it? how are they coming back & asking for more & more information??
I am confused!! Please throw light if you know more details...

yes, you can add her anytime before the approval of your I485 (3rd stage of the GC process). You havent mentioned EB1/2/3 but if its EB2 or EB3, stage 3 is several years away for you, and you can always add her before you apply for the final stage. Good luck!

My H1 stamping has expired. I have traveled using AP before. Just wanted to know if anyone traveled back with AP via Brussels?
Email I received from Belgium consulate just says "Indian nationals do not need transit visa". I am sure it means they do not bother about H1/AP as long as you have legal entry for the destination. Just wanted to re-check.

I and my wife are on h1. I want to come on her h4. She recently applied for h1 extension as her employer is nonprofit org and has some policies of his own, he files every year. She filled in may�09 and got receipt number, as the case is still pending who we can apply for h4 now. Is there any way around to apply for my h4 while the case is still pending?
You can file your H-4 based on the H-1b receipt of your spouse, this is not a problem. They will approve your H-4 for the same duration as your spouses H-1, you will get an approval of H-4 only after your spouses H-1 is approved.
