I'm going to India and is planning to get my h1 visa stamped...
How are stamping scenarios these days at Chennai?..esp"lly due to PIMS stuff...
I have followed lot of discussions around H1 stamping and people got struck for weeks/months in India due to PIMS and other issues..
Is it advisable to go for H1 stamping as i'm into 7 th year of extension and I can't afford getting stuck in India for more than the granted period of vacation...I have approved AP documents handy and can use them while coming back to US...
Can someone pls advise me on this?

I have been in H-1B status for 4+ years. This year, I started attending full time college and had applied for transfer of status from H-1B to F-1. However, my application is still pending with USCIS. Since I need to travel home urgently, I was wondering what steps should I take before leaving so that my status is not affected. Because if I travel abroad, I will be applying for new F-1 at a US consulate, do I need to cancel my application with USCIS here before leaving? Are there any consequences of keeping my application pending here.

Now for GC, if I mention the previous work ex in the form, do I need to provide the returns or something??
Not required. no need of them even you mention your work exp from india. Don't worry. just address is fine.

No, you don't need the I-864. The interview letter that you got might refer to an I-864, but this is often because the local district office has standard interview letters and they are more often for family cases than employment cases. I've seen this happen often.

Hi does anyone know the current processing time for AP at the NSC. The website says 3 months but has anyone got it sooner?
I applied on Jan 9, 2009..when can I expect it by?

Generally you get it within 60 days. You sent only a few days ago, wait until March. If they say 3 months, they mean to say that they approve application within 3 months.

I am Aug 07 filer , I was not able to submit my medicals with my I-485 application .
I got my medicals done with civil surgeon in sept 2007 and was waiting for RFE to submit the sealed cover . I never got a RFE but I got a interview at local office next month .
So can I submit the sealed cover that the civil surgeon filled in 2007 or do I need to get all the tests done again now and fill a new form .

Hi,
My H1B is with USCIS and my employer has received an intent to revoke.
I am planning to go on H4 and my questions are
1) Can my employer file for a new H1B ANYTIME regardless of whether my H1B is revoked or not? I heard that since i am already counted against the cap, it doesnt matter when the H1B is filed, once approved i could start work immediately. Is this true?
Or this can be done only till my earlier H1B is not revoked? And if revoked i will have to file H1B against the 2011 quota and start work from October?
Appreciate any response!!

Hi,
My OPT was approved and I received the approval notice. But the card itself
has been lost in mail. I have applied for a replacement card.
I am aware of something called the "I-9 receipt rule" wherein the receipt for
the replacement of a lost document can be used in place of the document itself
for a period of 90 days.
Does this apply to my case? In other words, can I use the receipt of the replacement
request to work for upto 90 days?

I think if you are out of the country for 1 year u can get 3 yr extension. But you would get counted in the quota though,fresh H1, I think.

My question is, it is mandatory for her to carry my original I-797 petition and I-129?? I have sent photo copies of both the documents, but I read some where that she has to carry originals of these 2 docs. can you pls clarify??

I applied an H1b through a consultant company on April 2008. I received a notice from USCIS told me had been lottery H1b. However, until now my case is still pending. My OPT expired on Jan, 2009 and can't be extended. I am in the middle of the 60 days grace period right now. My questions are:
1. If the 60 days expire and my case is still pending, can I legally stay in US till H1b approved?
2. If my H1b is rejected and the 60 days expire, how many legally days can I stay in US? Do I have another 30 grace period days?

Hello, I apologyze for not giving my name away first of all, secondly I need to know what my options are if my father and mother who are permanent residents in the USA can file an I-130 for me? They obtained their legal status thru the department of labor but at the time they were approved I was already 21 years of age (the whole process started in 2000and lasted for 5 years or so); one lawyer told me that I cannot do anything since I was over 21 but I just have been in a different lawyer who told me that yes I can adjust my status thank to a grandfather law that can help me to achieve my goal in working legally in this country. I am an unmarried daughter and 27 years of age at this time.
I just don't want to spend those $5,500 can this lawyer is asking me for his services, I appreciate very much your replies and my family will too

I moved recently with a pending 485 from NSC jurisdiction to TX as I see no problems.
