Can we apply for I - 485 without having the I -140 receipt notice.What is the work around so that I dont miss the Aug 17,2007 date for filing I -485.Are there any chances that my I - 45 will be rejected, or will I ge an RFE.
My I - 140 was applied during the 2nd week of July, 2007.

I have been working with company A since december 2005 on my OPT.
Company A filed for my H1 that was approved and the start date for this
visa is december 1st 2006 (OPT expires december 15th, 2006). I am
talking to company B that wants me to join in november but is not sure
if they can file for a transfer before my visa begins. I have looked
around in various forums but havent found a satisfactory answer.
I have pay stubs from company A but, of course, they would be dated from
before the beginning of my visa. Can I use these for my transfer
application? Is transfer even possible in my case?

I just checked my status on line and saw a LUD on my and my wife's pending 485 applications. My priority date is March 2006.
One reason that I am thinking off is that i had a service request opened on 8/22 when i went for infopass appointment and I recd a letter from USCIS dated Sept 30th with the usual template of saying that "we are processing your application bla bl bla and if you dont hear anything from us in 6 months please call us bla bla bla....."
However the LUD is not 9/30 but 10/7. I am wondering if anyone else has seen LUDs on their applications.
My AP and EAD have been renewed long back (about 1 month back).
Any response in this respect is appreciated

My H1 was denied the last cycle. The denial decision was posted on Nov 24th. My application was in RFE state for quite some time, hence the delay. The question that I have is, as the denial came very late, will I be able to apply for an H1B this year. We generally file all our documents on 3.31, I am wondering if I would not be eligible this year because 3.31 is not 6 months from 11.24. There is an rule that I cannot apply if there has been a denial in the recent 6 months. Please let me know if that is the case. Will I be ineligible for this year (3.2010).
I am currently in my 4th year on a L1.

You can enter all the data, save it and book your date as and when it becomes available. I did it recently for Chennai. But, if you do not book the date within one week of saving your forms, you have to enter the data once again. For Chennai, they normally open the dates 3-4 weeks in advance.

I signed an employment agreement stating that if I had to leave my employer before getting my Green Card that I will be liable for all the fees pertaining to the Green Card application which my employer has been paying for while I am been employed by him.
I have heard that an employer cannot hold Green Card fees over an employee. I also believe if anything, the fees owing should drop according to the length of time that the employee has worked for that employer.
I have been with my current employer for 4 years now and I wish to leave him but I do not want to pay him for the Green Card fees as I believe that should be a business expense to him.
I would just like to know what are my rights in the above case

I sent the applications(I-140,I-485,I-131,I-765)to Nebraska center 3 weeks ago and it was received by them on December 17,2007(because I tracked the FedEx package).Until today,no receipts yet and my checks are not cashed yet and the receipting update says Current for Nebraska, is the normal or there is something wrong?

I have got an RFE for my I-485 application. . I missed to complete a question (part3 and question #10) in I-485 form for which I got a request for evidence letter from USCIS. Can anyone has any template on how i should reply. Your help is much appreciated . Thanks in advance

Therefor submit an affidavit with your answer to this question a 'Yes' or 'No' response.

My wife was on same boat as many students. Her H-1B petition had an rfe. RFE was later denied and we still have MTR. This year she got her H-1B approved without RFE. We did specify in application about previous year rejection.
Bottom line is there are no easy trends to observe. Luck seems to play a big role than anything else. Obviously, all the documents must be in good shape.
