My son came to USA on H4 Visa. He completed his studies on F1 Visa and worked for some time on H1B Visa.

Then he went to Canada for higher studies. He holds Canada PR.

I am in US. If I apply for his I 130, would there be probem him visiting US on B2 Visa.

Current EAD was supposed to expire in Feb so applied 100 days ahead for renewal. To my surprise application got approved in 10 days:D. Hope they've given for 2 years and starting from expiry date of current one....
Which center did send your application to?

I had FP done way back in October 07..but there is no status change LUD on I-485..what to do??.:confused:..Do I take an appointment to talk to an officer or simply call USCIS ..

No. OPT means in F1. As long as you register for enough credits, your status continues. The enough credits is determined by your international advisor.

Folks,

When an h1b transfer via regualr processing (california center) is pending...and say the person gets fired /layed off etc....

Can another h1b transfer be done with just the recepit notice and previous I-797?

What's the risk? Some companies are not willing to do premium processing even if the candidate is ready to pay the premium process fee.

Hi,
My labour and I40 are approved and PD is 12/07 for EB2.
My H1B 6th year expires on 10/10
I am thinking of changing companies. The job will be the same.
My questions are:
1) Can I use labour or approved I140 from old company to new company since the job will be the same or does the new company have to go through the entire labour and I140 process again.
2) Since I am already at the end of my fourth year of H1B, is there enough time for the new company to apply for labour and I140 since I believe the GC process should start by beginning of 5th year for H1B extension.
3) Can I use the old company PD for the new labour and I140 or will the PD be new as well.

Hi,

I was an employee with company A till march 2008 and i kept a H1b transfer to
company B on march 24th 2008. I was working to company B for an year
on receipt number applied for h1b transfer at USCIS. I got an RFE with
company B in sept 2008 mean while my I-94 got expired on August 2008.
Company B answered the RFE and submitted to USCIS on October 2008.
After waiting for H1B transfer to get approved it got denied on march 10th
2009.

Now i wanted to change my status from H1b to F1(CPT).My questions are
1. If i apply for transfer from H1B to F1 will i be getting New I-94 from
USCIS?
2. Should i be going back to india for getting stamped after i change my
status to F1 ?
3. Can i be on a student status from the day i receive the receipt notice
from USCIS for change of status ?

I would really appreciate your help regarding this issue..

I got laid off from Company A in Jan.2009 but I filed transfer for my H1-B to Company B based on receipt notice which I have for Company A. but Just now I came to know from USCIS that Transfer which I filed for Company A in Oct.2008 has RFE and Company A denied to answer RFE cos I am no longer their employee.

Question:

1. Can I get a receipt notice for Company B ?
2. Is there really an Issue for my Transfer to company B due to RFE in previous filing?

Hi,I have filed H1B during August 09 ..my priority dates became current in Sep 09 and I have filed for AOS -485 /EAD ..Should I cancel my H1B or will it automatically get canceled once I receive my EAD ?Please suggest.

Continue working on H1B. Or, if you plan to change job use EAD. No action is required for cancelling H1B.

Hi,
Find below my current visa status

1. H1B 6 years completing in Jul 2009. My firm will apply for extension in March time frame

2. I have applied for I-485 and have EAD + AP.

I am planning to travel to India for a week on AP sometime in May. I have the following Qs on this

1. Can I travel to India with AP when H1B extn is pending.

2. Will I face any issue while entering the US if my H1B is denied (or) there is an RFE on my appln?

Please answer these for me.

Hello All,

I had attended H1 interview in last week of Nov 2007. I had got 221g BLUE form to submit additional documents from Petitioner.

I submitted all documents through VFS drop box in last week of Jan 2008. Does anyone has any idea within how many weeks time we will get some response from Chennai consulate?

I was not asked to submit passport and hence I havent submitted passport.
I appreciate any inputs from any one.

during stage 3, they require a birth certificate. what if I dont have a birth certificate? do they accept an affidavit from my parents with a domicile cerrtificate or not? i dont even have a school leaving certificate. please give me advices.
