Hi,
I had an important query on the following scenarios/questions
Let's say one switches from H1B to EAD as part of either the same job or a different one , then
1 on EAD should the person be making more than the Prevailing wage as shown on his/her Perm labor certification?
2 If ppl on EAD do need to meet Prevailing wage for their position then are they ok to meet the prevailing wage from when the labor was filed or the most current prevailing wage from DOL for that position??

I've been in the bay area of California for the past 10 months. I'm a Canadian from Toronto. I've been following this green card mess for the past 10 months and was well aware of it even while I was living back in Canada. I would like to join the Norcal chapter of IV to contribute my thoughts towards resolving this situation.

I had my I-485 interview at Boston-CIS in May,2007 and since then they were telling me lots of BS like NC, One security check open, additional review. Finally they sent me a letter telling me I need to attend NSEER interview at ICE office in Boston and I did that this week and the nice ICE officer told me that he was sending my file back to NSC. Last time I saw that thick file was when I was interviewed by IO at Boston-CIS!. Does it mean NSC will approve it now? I'm EB2 ROW and I was never finger printed more than once. So far had 2 EAD/AP and I applied in 2006 August

AILA Liaison has been coordinating with USCIS to help achieve this outcome. USCIS has the means to independently verify these cases.

Priority Date: Sep 2004
Status: Labor & I-140 approved
EB2: Labor got approved November 2009.
I'm trying to file 1-140 amendment with EB3 priority date. Currently i'm thinking of going with Sheela Murthy/Rajiv Khanna,
could you please suggest some good attorney who can handle my case very well in a limited time? Thanks a lot and really

Hello Forum Members -
My company has applied for my 8th year extension (3 years) based on my LC and I-140 that was applied in CA. (My LC and I-140 have been approved). But during my 7th year, I moved to NC state with the same company/department. The LCA for the extension includes both CA nad NC work locations and NC residence address.
Will there be a problem with extending the H1 using the I-140 that has been approved for CA? Will USCIS question why I am in NC when the I-140 shows a CA Address?
Please let me know your opinion.

All,
I'm a EB2 filer and PD is 2003. We did a concurrent filing on Jul 2nd, received receipt notices for the same, FP Completed and EAD approved.
I see the A NUMBER printed on my 140 and 485 receipt notices. I wanted to understand whether the 'A' number mentioned on the receipt notices is the VISA number or, the VISA number is something different that gets assigned during the adjudication of I485 based on the availability.
Trying to assess the impact of EB2 retrogression on cases that are already filed and Finger printing is complete.
Please Advise.

My PERM case has been pending for almost 15 months (under audit for 12 months). I asked my attorney about this enquiry thing that you can file to DOL after pending for 15 months (according to this thread (http://immigrationvoice.org/forum/showthread.php?t=21183&page=2)). Her response is that she has been sending requests about case status to the DOL on a regular basis.
Can anyone who's familiar with the matter tell me what's this enquiry is about? Is it just a regular status check or a more formal and serious matter that DOL has to assign a freaking living human to look at your case to reply? :mad:
