Are we/employees really supposed to know all the steps involved in the approval of GC process (Perm, 140/EAD/485 etc.)?
I work for one of the fortune 100 companies, to my surprise, none of my European colleagues is aware of all the GC process. All they do is just provide documents what ever the HR department asks for. They don�t pay from their pocket for GC (ideally correct). None of them has clue about priority date etc�.they get communicated by the HR department about their GC process.
So putting your case in perspective. I am assuming that the HR department would just hand over the GC to the employee. Neither the HR (I think) nor the employee (definitely) would worry about the PD being current.
Ideally if a law firm is point of contact for a petition, what would they do? Would they go back to USCIS and tell them that the GC is approved by mistake? I don�t think so but some one can confirm if they had experience otherwise.
I highly doubt the HR dept of an organization is filing labor certs, I-140s and I-485s without the assistance of immigration attorneys whether in-house or outside counsel. I work for one of the largest hospital chains n the US, and our HR offices use external counsel for immigration matters.

I called Kennedy and Cornyn. Asked them if they are aware of the issue. They are not. Did you call? Kennedy 202 224 4543, Cornyn 202 224 2934. I also aksed if Kennedy is going to send letters to two agencies as Rep Lofgren did as he is the senate immigration sub committe chair

I completely understand the frustration expressed by logiclife.
We either fail to appreciate or choose to ignore the fact that not every one is in the same situation when it comes to GC. For some, it is THE THING. For some it is just Nice to Have and some don't care. If it comes as a by product of being here so be it. Some of more desperate than others ...
Most people around here are educated and know what they are doing. I believe that was their decision and they have every right to make that.
1) I have a friend of mine, he is gainfully employed for his skills and his wife needs to be in this place for next 5 years. So he does not bother as long as his company applies for 10 to 13 year H1 extension (Which they did). Never visits IV, does not really care what happens around here.... I don't blame him.
2) Another friend of mine joined at a junior level and can't wait to get out of here with AC21. Now that he has MBA, wants to move up with AC21 (know, it is not allowed now). I told this person about our omnibus and he contributed.
and other people fall all over the spectrum of interest from apathy to can't live without it.
If I were in logiclife's situation I probably would react the same way, but I am NOT the leader of the org :) :)
I doubt who frequent here would have felt bad about the logiclife's comments, because it was just logic life being logiclife. :)
At the same time I don't think calling some one coward persuaded any one to contribute monetarily , If they have not contributed so far or decided not to. It sure would have released some of the frustration of some active members :)

I know there may be a number of people here who don't care about participation. But I also know they are outnumbered by sensible/mature members.
Occasionally administrators here start an emotional post, which is taken highly positively by active followers but not general population. Then there begins a war, Lines are drawn with elephants/horses on both sides.
This place is a complete disaster when it comes to PR.
One Solution - Close this place and stop aggravating people.
Real Solution - Do what is right forge ahead with defined agenda, don't make people ashamed or left out or make snide remarks as leaders/followers or activists.
Keeping a movement alive needs strong and open minded leaders. I think there are plenty of those leaders at immigrationvoice, Logiclife may or may not be one of them, i don't know (never met him or talked to him, neither have the desire), You don't have to make people join the movement, movement is when people follow with their hearts.
Since I am back in "red" after one Logical question on Logiclife's post in three months, I will go back to my exile, and let activists/followers rule this movement.

We are quick in jumping at each others throat for no apparent real reason ! Being part of a forum is sharing space with others, with those whom you disagree, and those who disagree with you. Argue logically, but don't make it a personal fight.
Don't agree with someone, make your displeasure known. If things seem to be getting hotter, ignore the other person. Live and let live. We have bigger issues to worry here - GC mess - instead of who said what !

My experince in porting EB3 to EB2.
One of my friend labor was applied in Eb3 since he was not eligible for eb2 in 2002. His labor and I-140 was cleared in 2006 and waiting to apply I-485.
Meanwhile he got promotion in same company. So he applied for EB2 labor.
(If 50% of job duties change you can claim experience gained in that company.)
He applied another labor in Eb2.
Eb2 labor cleared from same company.
I-140 cleared (ported old priority date.)
Applied I-485 in early 2007.
He got GC by end of 2007.
My case was also similar.
My labor was applied in 2002 in Eb3 since i was not eligible for eb2 in 2002.
Labor and I-140 cleared in 2006.
Got promotion in same company. I asked my company to apply labor in EB2 and port PD. They agreed to pay potion of the cost.
My Eb2 labor approved in 2007 (perm)
I-140 approved but Texas service enter screwed my case they did not ported by old priority date. I-140 approved with PD date 2007.
My attorney requested USCIS to port PD but no luck till now.
I spent 7000$ for this.
Bottom line is Porting of PD from Eb3 to Eb2 worked for some people only.

Your post absolutely doesnt make sense. You are asking us here "485 RFE and USCIS asking paystubs for employer you never worked"
This does not seem to be a 485 RFE but a H1 RFE. Put some sense into the post before posting here and confusing people. How can yours be a 485 RFE when employer X never sponsored your GC and when USCIS is asking paystubs from Employer X for H1 transfer and when your GC is still running with Employer 2. Senseless post.
Well...I got the mail from USCIS for I-485 RFE. Not for H1 as you thought.
Please note all H1Bs, F1s, visas....are part of 485 application.

My wife is currently with Employer A on her 7th year H-1B which is valid till Sep 2009. She also has her approved labor cert and I-140 from this employer, but decided to continue on my I-485 application. The I-140 however is still valid.
She now wants to change jobs to Employer B using H1 visa transfer. I am guessing she will need to include a copy of approved I-140 with her H1B transfer application. But Employer A is not providing us a copy of the I-140 approval.
Can someone please advise what we can do in this situation? Is a copy of I-140 critical in this situation? Or just a copy of online approved status will be sufficient? Any other ideas?

Buddy...take it easy on yourself. I can feel your pain, waiting for almost 10 yrs now...still no sign that this wait will end anytime soon.
But rather than blaming the system and whining, i keep myself content with the fact that no one is forcing me to stay in this country- it's my own choice that i want to continue taking their bullsh*t.

You are right that it is a long wait...for me ten years is almost coming, but no relief yet. I hate to get these documents renewed every year. It is a vicious cycle whole year round to update one or the other document in different points of time. It is becoming a nightmare when we could do something useful instead.

For all those who don't believe in IV - First, thanks for giving me all those reds :) I guess that is the best you can do anyway besides complaining about IV. Second, if I understand it correctly you want to be associated with IV but on your terms. Every organization has a goal and it's own way of doing things. Take for example the companies you work for. There are lots of things that we don't like about our companies; do you go complaining about those to your board of directors?
Transparency? The only transparency I have and I need is that IV is the ONLY organization looking out for the highly skilled community.

yes I 140 has been approved in Feb o7.
Let me wait for actual denial letter.

For AP documents, it says we can submit any document issued to you by USCIS showing your present status in US. Now, currently I am on H1B. So should I send them my I797 approval document or EAD copy? Also in there instructions they are asking to send copy of an official photo identity document showing your photo, name & DOB? Can it be PP/DL/EAD?
Your status will be shown buy copy of I485 receipt. AP requires the following:

Based on the various discussions in this forum, the number is expected to be around 20k. No concrete evidence for this claim.
It will be interesting to see Sep bulletin. Because at present except EB2 I & C all other categories are either C or U. So, each and every visa will go to EB2 I & C and there will be plethora of approvals beginning Aug 1st. I-485 processing date is in July ’07 (both at TSC and NSC) and all the pending EB2 (till June 1st 06) may not be ready to adjudicated (RFE, denials, I-140 not cleared etc). If the above numbers are correct and given the fact that additional numbers will be available beginning Oct (2008 quota), there is bright chance that EB2 dates may still move further. This is my personal opinion.
