Hmmm....I am still wondering...
1> How much money an applicant will spend on MTR? on self, on dependents?
2> How much money an applicant will bleed to move to US District Court?
3> If an applicant is working on EAD during all this farce, would he be able to continue working (atleast seeing paycheck) or will seat at home and bleed more?
4> if he looses EAD job, will CIS again punish him for not having a job?
5> Even after doing all these above, what if he accumulates 180 days of unlawful(?) presence? will he be deported for following the laws?
6> Last question: Are those undocumented workers are better positioned to get legal citizenship in long run than those legal skilled immigrants from retrogressed countries?

I have a suggestion we need to meet the senators office in person and also try to get more visibility in terms of getting exposed to media may be channels like
a) AZN TV
b) India waves
c) CBS
d) NBC
Since we have hired Quinn & Gillispie we need to understand whats their strategic plan and what they have in plate for us. We need to have vision in front of us. All I am trying to say is identify the senators who would favor the CIR/SKILL Bill etc and have the immigrationvoice.org volunteers meet them in person. Some of the things I have mentioned may be redundant but, I wanted to make my point clear, calling the senators office just a week before with phone calls webfaxes etc is not just bearing any fruits as we have learnt from our past experiences.

we are not talking anything new nixstor, there are people already waiting for years to get name check done......dont think if you pretend like nothing is happened will get a GC within a year....even though we might still stuck for years in the name of name check
May be you are right. I am pretending like nothing has happened. But Those folks who are adding spin to the issue on security checks, are you focusing in any way on the root cause of the problem. My point is, If you bring security on, every thing else is shelved until security is fixed. If its already there, let it be there. Let AILA figure out in the law suit how they approved. Let Rep Lofgren do it. Why should we stir up the hornet's nest on digg and open doors to anti guys to tighten security checks on us. Its like we are going out there and saying that "yes, My buddy got GC in 6 months. The security system is not working. Please fix it " What will be the result?

Finally at last today the web site shows that my Labor is certified. I am really glad at it. PBEC has shown us the HELL on earth and though I am 43 years old, I feel like much older than that due these PBEC guys. They never realize that this is our biggest milestone.
My NOF was on Prevailing Wage as my pay was 65K and PBEC wanted to increase it to 87K. But our attorney's have submitted third party surveys and we have given up thinking that PBEC will not agree for it.
I know how hard it is to live without a status. I pray that PBEC guys releases every one from their HELL. Details are in my signature.

Interesting case, did you port your PD or??
I think this person was indeed trying to port to EB2 some time back, but even the EB2 had a PD of Nov 2005. So even if the port succeeded, even that would not explain the out-of-turn approval.

Yeah, PD is April 2005 EB3ROW, and its just frustrationg when you see a lot getting their approvals with a much later PD's. He was scheduled for interview in Aug. she already recieved her packet 4 when Aug vb came out and reinstated July VB. I knew that it had something to do with July vb fiasco since he got his packet 4 after July 2. There were no visas left for that time, so AUg. vb doesn't really matter.

I had an email conversation with my lawyer regarding 180 day portability. She said that the count for 180 days should begin with notice date for safe side.
However the count begins with Receipt Date which is a day or 2 off from the actual application receive date (mail received date).
This is what i got from my lawyer.

I assume yours is a conventional loan, how much equity do you have on your home, and how much down payment did you make on your home purchase first time?

Does anyone know/suggest how to handle this delay? How are Ombudsman conferences held? Are these adhoc or with a certain frequency? We need to bring this up somehow. Recent USCIS reports show varying numbers of cases processed. But no one will know about our delays of existing AP cases unless we bring this to attention through murthy/Oh firm/ombudsman...somehow?

Other than the visa recapture, I guess at this point there isn't a whole lot we can do. I guess when we applied for GC we basically pawned our life to USCIS.
It is kind of sad that when they had visa available they weren't able to approve the cases before April '03. Pathetic!!
Enough of venting.... hopefully things might work out for the better this year!

A thought comes to mind on reading your post.
Is that what the average Amrican wants us to do? Do they want us immigrants to be kept away from participating in innovation? Do they want us to keep working mundane jobs? Do they want us to lag behind them?
This is just a speculation no hard proofs but only a thought.
Isn�t this what the American companies want?. They get qualified people who keep doing the same job for less and churning millions for the companies. Also, the big companies are fighting to get H1s quota increased, they do not care about whether these people get GCs are not, being in H1 for long serves them right.
Isn�t this what many people here want?. They can boss over us for many years even if you are more qualified then them since you cannot change your profile.
Isn�t this what the government want?. American companies are making money, many people are happy. Then why change the situation?.
How much percent of the immigrants who get GC go on to become innovators and start their own company?. I would say less than 10%, that also could be a far fetched figure.
America gains more than it loses.
