In any case i really prefer all you EB2 I guys get their GC and get out of our way so that we EB3 I guys get our (GC) seeing that is the only way we will get ours. :D:D:D
At least if not GC i hope you guys get to file 485 to receive benefits like EAD and AP. Then you will not have to worry about going to India for a vacation. I know it is painfull to go to the embassy again for stamping.

AILA has reported that the EB-2 cut-off dates in Visa Bulletin in May 2011 may progress ahead substantially because of large unused EB-1 numbers since October 2010 since it has about 12,000 unused EB-2 numbers. Very good news from AILA and Mr. Oppenheim.

I have been thinking about whether to attend the rally or not from past few weeks. Attending the rally would require me to take a day off. Finally today without thinking twice I just went to my manager asked if I can take day off on 9/18 instead compensate the work in the following saturday. It was approved and I am attending the rally on 9/18!
I am feeling so good now.
Also, I live in DC area and can help if somebody needs to be picked from airport to the rally and drop them back if needed.
Hope to see thousands on 9/18th...

This might work !! We should have state chapters collect a minimum amt of $50 or so and register people who agree to attend the rally. Then upon showing up on the rally day they will be reimbursed the fee...!

And SOA, if urs is not a labor substitution, u better send another i 140 application along with ur i 485 as concurrent filing. No harm in doing it and u will be safe side.
I think 140 cannot be filed twice as it needs original labor.
So i guess we shud try to send a proof that it was filed and reached uscis on a specific date.

Congratulations and enjoy your green card! Don't worry about the priority dates not being current when yours was approved. My green card was approved in September 2007, sometime after the July fiasco wherein the PD for all categories became unavailable. Since my gc approval, I've been in and out of the US, and I hadn't had any single problem getting back in.

I filed for my wife's AP last month and here's what I had included
1. completed I-131
2. two photos according to the spec
3. her I-485 receipt notice
4. copy of her DL
5. and off course a check for $305 ;-)
That's it ! got the AP within a month, please read the instructions thoroughly, it's all there.

Thanks. I know I am bugging you with my questions because I am filling all the forms today and sending. I have one question :)
For AP documents, it says we can submit any document issued to you by USCIS showing your present status in US. Now, currently I am on H1B. So should I send them my I797 approval document or EAD copy? Also in there instructions they are asking to send copy of an official photo identity document showing your photo, name & DOB? Can it be PP/DL/EAD?
Your status will be shown buy copy of I485 receipt. AP requires the following:

She is very slow and does not even talk to you. The staff working in thier firm is arrogant. I was current in June but they didn't apply eventhough i sent my papers in May. Instead they were cursing DOL for the July bulletin withdrawl. They'll never respond to emails properly. I strongly don't recomment Jennifer Hallet.

They have to do those work anyway. Because all the applications are not I-485 and also some ppl filed I-140 along with I-485. So, they do have to repackage those applications. Let us see,how events develops for couple of more days?.

Well...I am one of us stuck in EB3. I do qualify for EB2 but my employer choose to file it under EB3. I recently invoked AC21 and moved over to a new employer on my EAD. Is there a way I can ask my new employer if they can file new I140 under EB2 and change my category to EB2?
I am also like you. As I have been searching this forum, I understand that you can ask your new employer to process a new EB-2 PERM, once it is approved, the new employer can submit for I-140 with interfiling of old PD of EB-3.

How does passing CIR help us? I didn't really have the energy to go thru the whole bill but it didn't specify what "line" those 20+million ppl who eventually get amnesty will be processed in. If they line up on EB3 or a supplementary bill in the future decides to allocate some EB3 to a "Schedule B" (just for example), then we are right back to where we started (but add more years to the waiting).

1. MBA from a top 10 school - completed this year (not just because of retrogression..)
2. Picked up Golf (although I have no aspirations to play on the PGA Tour :))
3. Focus my energy on pursuing new hobbies - e.g. a photoblog (I'm into digital photography with SLRs)
4.Volunteering at work (social and other organizations)
5. Apply to Canada as a backup ( On the keyboard of life, always keep a finger on the Esc key. I read this somewhere...)
On top of all this, I applied for a 7th year H1 extension 6 months in advance by paying the premium fees. I've now got a new job offer and am exploring filing a new Perm+140 with the new employer quickly. Some may think it is risky (which it is) - and ditching a 2003 PD is folly of course, but bitching about the GC process and speculating about SKIL - DREAM - CIR won't do much when I'm 40 years old :)
