I think DOS knows a damn when they move the dates (I think everybody agrees with that) They still move their dates based on demand of approvals from last qtr / month and they calculate the expected demand. I think they are probably making the assumption that everything is normally distributed (atleast this is my assumption). I dont believe in numbers, but lets say for example :
If you see that for March they have about 43 EB3I applications current and through April they have made 55 EB3I current and they added only 8 apps through 2 months. (Also Chennai consulate appointment numbers decreased from 10 to 5 from March to April) But on the other hand, by making EB2 Dec 2003 they have added 150 applications to the pool. This does'nt make any sense.
I agree that there could be indians who applied EB3 and dont work for IT and not have access to or perhaps dont want to track them, but again it should not be too much when compared to EB2.
So in my opinion, if DOS calculates the same way they do the EB3I dates should move to some where in Jan 02 in three months and the last quarter is going to move to the end of 2002.

23 (out of 31) of the co-sponsors for HR 5882 are Dems. not to mention the main sponsor is also Dem.
I did not say all of the dems, by same token not all republicans support immigration (legal or otherwise).
What I am saying is that generally, republicans have (even if it is to spite the efforts of people pushing illegal immigration) been more supportive of legal than illegal immigration.
While many democrats have been supportive, the one of the main reasons for the delay are the dems themselves, their crappy CHC, who dont want to allow any immigration bill till the illegals are elevated on the pedestal. The Dem leadership have put the immigration issue a hostage to the whims of CHC.

Republicans are generally more amenable to legal immigration fixes than Dems. While not all of the Dems are bad, most of them dont care about legal immigration -- they just want the illegals. If it were not for these Dems, 5882 would have sailed through by now
I am sure NoBama will say CIR. illegals first. etc. etc.
I am not sure how much the next president will affect the passage of the bill through the two houses since they were majority democrat and will continue to be majority democrat. Senate is projected to continue to be majority democrat even after the upcoming election (when 1/3th of the Senate seats are up for election). A Republican president might not veto such a bill. Not sure if Obama would veto a bill which has passed through a democratic majority vote. Just a thought........I could be wrong.

Seems like this is just a Republican backed bill. Dems will fight this or insist that some provisions for illegals be included as well. Also once elections are over it is possible that the Dems will be majority and then this bill gets kicked to the side.

The "Opportunity" usage has been explained much beyond Hiring in the other laws and related documents. Hence, an employee who subsequently faces discrimination because he/she cannot progress or misses on job advancements due to Visa limit restrictions is certainly being discriminated against.

Example:

This is a great finding I've read that page, but never noticed the Secretary of DHS specifically mentioned Pre-Application of AOS. Now that they do have this in their mind, can we start working on that? I'd love to share a few thoughts I have on it:
From the lessons we learnt from the past, the most important thing for this admin fix to fly is compromise: there must be kind of restriction for the pre-application AOS. A few examples I could think of are:
- The person has been in the country LEGALLY for more than a number of years, OR
- The PD are more than a certain number years old, OR
- I-140 has been approved, OR
- Must have MS or higher for a US college (just for argument's sake, please don't flame me).
The key is to not allow everyone to file pre-application or it'll be drown in a media storm and draw backfires. Yet it gives you a certain promise that you'll be able to file pre-application once you are here for a certain period of time, so everyone has hope and those who has suffered more would have an almost certain chance to do so.
IV core, should we work on this? This is the first time we see pre-application of AOS appears in official file and I believe it's a great opportunity.

YES Baby!. I am making it to the Sep 18th DC Rally. I am also bringing my parents (who are visiting US) along with me to the rally. So, total count is 3.
Initially, I was planning to take them to just NYC. Now I changed plans and decided to show them DC as well. Since we are talking about Washington Monument and Capitol Building, I don't think they will mind at all :).

Guys I need to tell you my story:
Last year HP acquired my company called Knightsbridge. Fragomen is HPs law firm. Everything was going well until we had this monster called fragomen deal with us. My I-140 was approved way back in 2006 and was waiting for a Jun-2005 PD to be current. In July 07, when VB was released, Fragomen suddenly found a problem with labor certifications of around 100 people. They had access to labors from Dec-06. Only they know what they were doing between Dec-06 and Jul-07. In june 07, the PD had moved a bit forward to 2004. That time Fragomen contacted a few employees to file 485. As soon as Julu-07 bulletin came out they suddenly changed their tune. The word "travel required for job" was missing from the labor. Fragomen advised HP not to go ahead with 485. All our arguments were falling on deaf ears. All independent attorney opinions were disregarded and HP decided to take fragomens advise and not to file 485 but to restart labor.
After my new labor got approved, I asked fragomen to apply for consular processing in my case. They tried to escalate it to various levels in HP and pressurise me to file I485. Finally I told my boss, I want consular and also picked up a fight with HP employee not to interfere in my GC process. Because this employee always sings the tune of fragomen. After this, they have not shown any interest in filing my I-140.
After restarting labor Fragomens service is generally upto the mark, however; they are rude and uncompromising, in that they will not share a copy of labor certification or I-140 with employee. To some of my coworkers they will not even bother to respond to him for his 7th year H1 extension despite numerious queries. One of my friends also got better than expected service in that they filed his 485 just 2 days before his PD was moving from current to retrogressed. That is the only one case I have seen with positive outcome in my company. Some employees from my company suddenly went into silent mode after July-07. I suspect, they were given under the table deals to go ahead with old labor. However I can not prove that.
After seeing all this behaviour, I have come to conclusion that Fragomen will give you good service if they see good potential revenue from you in future. Like EADs , APs etc, multiple H1 extensions etc. I think they are very money minded company and feel that they proactively advise employers to go slow on immigration and they also advise employers on how slow immigration could benefit the employer in the long run. They are completely unethical in my personal opinion. When they were describing the situation to our managers in Jul07, they were very insensitive and were showing as if nothing else had happened.
No one was held responsible for this fiasco and all good hard working people were left to suffer. Due to this I have come to despise fragomen and I also despise some big employers who use them. Here is the list:
HP, Cisco, TCS, Deloitte, IBM, ...... add yours to the list.

Now a days any junior, if they ask me about GC process, I ask them what is the law firm of the company and find out how company handles GCs. Like, do they file at the last moment? do they get into a holding pattern and delay everything etc? One of the questions I directly ask people who seek my advice is , is the company's law firm fragomen? If they say yes, I ask them to talk to their manager and stay away from fragomen and change their jobs if its a slow process.

After checking in google, I found this information and felt very happy about it.
Until yesterday I was not aware of this condition and expecting the benefit from IRS. After checking the IRS schedule and validating the benefit, I was shocked when it said not eligible because of ITIN reasons. Initially I thought it was a mistake by IRS and called them up but there was no answer.
Now, I have little hope that they'll classify people who filed H1+H4 jointly should atleast consider for $600 benefit. I'm with two children and had initially high hope and a long list for spending the amount. But now that is all past....
I would like to thank you everyone for taking this step of passing on the information and following up with legal, SSA & IRS authorities. Please do let everyone in the list know if as a group anything can be done. I would also like to share towards it. I live Redmond, WA.
This is not right when other people who filed singly received the money not we. We're treated as illegal and I believe this is a discrimination for this group of people.

Its a shame that Sen Kennedy's website gave examples of how people ranging from 50-89 points can get GC's. Just call it diversity visa. Its a lie of massive proportions. After reading the exchange of zoophilic and acrimonious emails this evening, it seemed like reading accounts of state assembly sessions back home. Well, we never miss a chance, do we? For a change, please read General Pace's testimony to the so called 'hearings' earlier today. Contrary to the visible and glaring episodes that stand out in our day today life being targetted upon as immigrants or wannabies, posmd's words are solemn and should encourage us not to lose hope: "If you notice, despite all the bad press about illegals, despite 9/11, the majority of americans are still pro legal immigrants, we are largely to credit for this, along with the pride they have in their forefathers who made the same journey". General Pace's testimony today is a sample supporting the above. Ghost, it was nice of you apologize for your 'list-rage'; hopefully, whatever be the intentions, ForeverGC will learn to see the spirit
