I have been thinking about whether to attend the rally or not from past few weeks.
Attending the rally would require me to take a day off. Finally today without thinking twice I just went to my manager asked if I can take day off on 9/18 instead compensate the work in the following saturday. It was approved and I am attending the rally on 9/18!

Jaime, your thought of having one more rally in Silicon Valley is a good one but again you are going to have the same crowd..!!
People in neighbouring states of DC did not make it , you tthink they will make it all the way to west coast! very doubtful!!
We should aim at bringing in more people to this family as possible..
Looks like a simultaneous rally on a weekend will be very effective!
And this time for the rally we will carry one one slogan banners
'SHORTEN THE WAIT FOR LEGAL IMMIGRANTS' or something similar!
just a thought!

factory man dont talk non-sense!!!!!! what is the goal your trying to achive!!!!! will you get anything????? tell us! if we suceed in preventing the release of 90,000 visa for scheduled A (nurses and PT. do you think they would allocate these visa for H1B... i dont think so factory man.

Gautam: If you have difference with Immigration Voice's position in opposing the merits based system that gives 21 points being illegal and 20 points for having MBA or MD, then you are entitled to have that opinion, but dont peddle your agenda on this site and find another website or forum to advocate in favor of merits based points system.
Merits based point system awards supplemental points for illegals. Being illegal is not an accomplishment. Having an MBA or MD is. The two cannot be awarded merits on the same scale.
Merits based point system works well in countries that dont have annual caps. Like Canada. Their objective in Canada is to fill the country with younger working population in order to balance to demograph that is headed to an aging population. USA is not like that and having points system in conjunction with numerical caps will cause greencard to go to paper-tiger resumes that have lots of points but not employable. There are millions of Ph.Ds in Science in India and China and they would not be employable here but would get GCs. Just like Canada, we would have greencard holders with Ph.Ds and MBBS driving cabs. Employability has nothing to do with papers that prove how many years you spend on colleges accumalating degrees.

I haven't researched L1 quota and its intent so I really can't comment further with respect to that.
Its unfortunate that legals and illegals are measured on different scales and it would be very unfair if they end up getting more benefits than us legals. I am not sure what you mean by illegal spouses? Either one is illegal or one is not.
I wish you the best in your search and would highly recommend exploring the unpaid internship possibilites in the interim.

Inspite of this rumor, they sent us urgent email, that they are working overnight this weekend and if possible they wud like to dispatch our 485 papers before saturday noon for Monday am delivery at uscis. We were impressed. They even didnt asked for the attorney fees in this moment , we just submitted the filing fees.

I can understand the quality and committment of lawyers can make a huge difference especially in this unprecendented situation where all EB categories are made current now and now there is a rumour that it would be retrogressed back probably sometime next week with a new visa bulletin.
A lot of lawyers who are really committed and sincere to their client's clause: Getting them Green Card, are working overnight and over the weekend also so that their client can file I-485 ASAP and on the other hand few law firms are acting as slackers and not even responding to their client's emails.
Anyway, I am interested in knowing everyone's experience ( good or bad ) with law-firms and their recommendation.
My Own Case:-> I work for a multibillion dollar telecom company and joined this company almost 15 mos ago with a promise that they would start my GC immediately. Till Now, they have not yet file my labor. Their lawfirm is Larrabee http://www.larrabee.com/ in sanDiego. I don't have much experience with them as my application is still in my company's internal queue but based on the basis of my little experience, I would certainly not recommend them

I agree with OP that we should know what's going on. But at the same time there is nothing called free lunch in this world. I suppose some guys in this forum have lot of time and energy to vent it out on each other. We won't achieve anything with all this fighting... but seems we are best in altercating with each other. Some times I just wonder whether folks out here are really skilled immigrants (gimme red dots)?? We should better do something constructive..

Hi All,
I got a notice from uscis on sept 24th stating that my 485 has been withdrawn as my previous employer withdrew my 140. I filed in july 2007 , and ported to a new job in April 2008. I filed an MTR on 24th Sept, but the status of the MTR is still received and pending. Its going to be 180 days since my 485 has been withdrawn on march 9th. And my lawyer is saying that i have to leave this country if we dont get the MTR accepted before 180 days.
Gurus could you please suggest some ideas on all possible steps that can be taken..

As per my knowledge, your lawyer waited too long and he/she may not be very well versed in immigration matters. When MTR is pending and If you do not receive anything within 60 to 90 days, you should immediately file an appeal in court. This is what I read on some forums, but I am not a lawyer, consult a good attorney soon. You need a seasoned professional immigration lawyer for this. Wish you very best of luck!

I am not sure if I understand your question. Do you mean to ask if the lack of pay stubs will be a problem if you file before Oct 1? There is no way that you can get pay stubs before Oct 1 because you are not allowed to work before that date.
2. Actually what's difference between getting the "transfer" before Oct 1st and getting a "new" H1B before Oct 1st? Is there some procedure difference?
The determining factor here is the timing. The term "transfer" is used when people have an H1B and they are under H1B status, meaning they are working already, in this case after Oct1. For example, Mr.X has been working for company A and gets a better offer for company B. The latter would file for an H1B petition in his name and under AC21, he would be allowed to start working with company B as soon as there is proof or receipt from USCIS of the H1B petition. That would be what is referred to as a "transfer".
The second option is to file before the H1B petition from company A takes effect (Oct 1). In this case, company B files for a new H1B petition in his name and instead of being able to start working as soon as the receipt number is received (AC21), Mr.X needs to wait for the application to be approved by USCIS. This can take anywhere from 2 weeks if done with premium processing to up to who knows how long depending on his case.
Keep in mind, that no matter what, you will not be able to work before Oct 1.
I would highly encourage you to ask an attorney for advice because this is a very important decision and you should not guide yourself by postings. I can only tell you what I have been informed and what I have researched, but I am not sure how it applies in your case.

Picture your freedom!
You are contributing a lot to your job, but are underapppreciated and underpaid. You have a business plan, venture capital and the ability to immediately start a business that will employ several Americans. You resign from your unfair employer. You go and start your business, and you start seeing it grow. Your spouse gets a new job, your children are about to go to college at a great school with in-state tuition. How is all this possible? so far, Senate Majority Harry Reid alsked the republicans to "stop" these things.. but we know they managed last year - so, if we don't do something, we may end up not receiving rebates this year also.. especially given the fact that Obama is trying to get support for this to pass in senate and not one republican voted for it in house...

Hi All,
I applied for my daughter's PIO card and sent all the documents as mentioned in the instructions sheet of the embassy website along with the self addressed stamped envelope. I heard from my other friends that even after you send everything in order, the embassy people would call and say that they did not receive the self addressed stamped envelop. It happened to three of my friends. I am the 4th one. They called today to tell that I did not send the envelope.
The funny part that happened with my friends is that, they all sent $20 and the package came in the very envelope they sent in the first place, that the embassy said they didn't receive.
Did anybody of you also had the same kind of experience or similar incident. If so, please do share.
Why are they doing like that? Do they really think we would do like that, trying to save on an self addressed envelope? It really bothered me for the fact that the lady from the consulate was utterly rude when talking. I am amazed how in the world, The Indian Government is still hiring such people? Of more then a billion population, is that the best person the government of India could find for that customer service post? Its a shame and I am ashamed that such dic*heads working and representing India?
Coming back to the issue...she said sternly, send $20.00 or send envelope stamped otherwise the application would not be processed.
Folks, please let me know where I can complain about this careless attitude of this monster woman. What steps can I take to make sure they don't do that again? I live in TN and I can't fly/drive to Washington DC. The questions is not about the money, but the way they are operating without any ethics is deplorable.

I am sorry to hear your experience at indian embassy. I sent the PIO card app for my daughter to Indian Consulate Houston and they did not require me to send a self addressed envelope. Included $20 and i got the card via FEDEX. I was surprised that the total time to receive card was about 7 -10days counting from the day i mailed the papers.

The funny part that happened with my friends is that, they all sent $20 and the package came in the very envelope they sent in the first place, that the embassy said they didn't receive.
Did anybody of you also had the same kind of experience or similar incident. If so, please do share.
Why are they doing like that? Do they really think we would do like that, trying to save on an self addressed envelope? It really bothered me for the fact that the lady from the consulate was utterly rude when talking. I am amazed how in the world, The Indian Government is still hiring such people? Of more then a billion population, is that the best person the government of India could find for that customer service post? Its a shame and I am ashamed that such dic*heads working and representing India?
Coming back to the issue...she said sternly, send $20.00 or send envelope stamped otherwise the application would not be processed.
Folks, please let me know where I can complain about this careless attitude of this monster woman. What steps can I take to make sure they don't do that again? I live in TN and I can't fly/drive to Washington DC. The questions is not about the money, but the way they are operating without any ethics is deplorable.

I am sorry to hear your experience at indian embassy. I sent the PIO card app for my daughter to Indian Consulate Houston and they did not require me to send a self addressed envelope. Included $20 and i got the card via FEDEX. I was surprised that the total time to receive card was about 7 -10days counting from the day i mailed the papers.

You are missing the key point here.
Equal Employment Opportunity applies only to applicants who are eligible to apply for that job. It does NOT apply to immigrant visa allocation and any other visa benefit such as H-1B approval.
In other words, Equal Employment Opportunity is applicable to US Citizens and residents with work authorization (Green Card holders, EAD holders, person with H-1B approved) and this is limited to job hiring, job promotion, discharge, pay, fringe benefits, job training, classification, referral, and other aspects of employment. This does not extend to immigration benefit or opportunity lost due to lack of immigration benefit (such as I-485 approval).

Good news for some and not so good news for others. I have been waiting for my labor for last 4 years and have still not got the approval on hand. So I am not ready to apply for 485. Where as a friend of mine who came to US last year and applied for labor through perm 2 months back has his approved labor and can apply for 485. I feel this is kind of unfair. The dates should have progressed slowly but steadily instead of trying to create a mad rush now.
