    I cannot believe that after everything that's happened over the last year or so, out of how many thousands of members of this group - just 199 of us called??

    What are we doing as a group of people? Is it such a wonder that this country isn't moving on our immigration woes when we ourselves won't pick up the phone and talk to somebody about our troubles?

    Wow-talk about complete and total apathy....I'm ashamed on behalf of each and every one those people who think they'll let someone else solve their problems - in which case I hope they don't ever complain about their lot in life. They have no right to.

    Absolutely shameful...

    If this is the level of participation we cannot and should not expect any thing. Just think about this there are a lot of anti's out there and they can and will vote. to offset that the volume of calls from us the non voters has to be substantially large. I called got my wife to call and a couple of friends I will try and talk to all my friends in TX to call as well. But that will just no cut it unless all of these 24000 so called members (I do not consider passive readers members.) will call and get all of their friends to call. I promise you when we get that level of participation whoever be the president, whomever hold the majority in House and / or senate our bills will be brought on the floor will be voted on, and will be signed by the president!!!

    But until we do not have participation our voice will be small and nothing will be done. And we will keep on waiting forever...

    Now go ahead and give me red dots. but my only request is please call and get your Husbands/Wifes/GF/BF to call. I will be happy with red dots if you at least call.

    To pbojja, if you think being concerned about fraud desi companies and highlighting issues we can resolve easily (like English classes) is being disrespectful to one's fellow country men/women, then I must not have put forward my point clearly and I apologize for that. I never said that only English speaking skills were required to be a good professional. However, they are important tools for effective communication. Not every desi IT professional in the U.S. is a developer and is in roles which do require good English speaking skills. Anyway, I didn't mean to be disrespectful to anyone.

    To sri1309, I never meant to digress from existing items on IV's agenda. All I am saying is that the backlog might get cleaned up a bit if we are able to assist in weeding out fraud cases.

    I agree.. Let us focus on the main agenda "APPLYING FOR AOS WHEN PD NOT CURRENT"

    I read through your reply, however, I found it extremely hard for me to accept your points. You've been probably on EAD too long to remember what a dire condition you came from as an H1B worker. Let's look at it:

    As an AOS, you can:
    - Work for any employer
    - Not work at all
    - Travel out of the country without worrying visa delay
    - When you got laid off, no need to worry about being out of status or restarting GC

    As an H1B worker:
    - If you are laid off, everything, years of wait, thousands of dollars, down the drain, and the whole family becomes out of status immediately. And in this dire economy, this is a sword hanging on the head of every H1B worker.
    - Worry about re-entry visa each time you travel

    With such a huge different, I can hardly convience myself that EAD is 'useless' or 'waste'. True, you'll need to work for same or similar job, but compared to the benefit, it is not nearly as big a problem faced by H1B workers day by day.

    Well, I just made my third call and the lady sounded quite confident that applications that have been received and are in processing are not affected by this and it's only NEW applications that would be coming in after July 2 that are affected. I understand what you're saying that they don't assign it but I have read before that they "assume" each application qualifies unless they eventually figure out otherwise. And now I am making my own assumption that if they assume it qualifies then it's assumed a visa is indirectly assigned? Wait, I'm confused:D.

    I've noticed that it's hard to get someone who can sound like they are really sure of the information they're giving you. I wonder if they're reading from something or just guessing sometimes. i shouldn't have to use the internet to get my information, they should be the #1 information center, and they can't even do that.:(

    Below is part of a message I posted in another discussion, but this deserves it own discussion. If you are a legal resident of the US, such as an H4, even if you are a child, and you have an ITIN, you can get a Social Security Number, because that is the only way to get the Economic Stimulus Payment.

    Be forewarned that the SSA will put up road blocks. You will likely be denied your first application. However, the law is clear and there is no cost to apply. You also have a right to appeal. A cover letter explaining why you have a RIGHT to a Social Security Number will help support your case. You letter should refer to the laws and statutes cited below.

    The only way to get the stimulus payment is to obtain a Social Security Number for "non-work" purposes. The SSA may issue an SSN to an alien under the following provision:

    20 C.F.R. � 422.104(a)(3)

    (i) You need a social security number to satisfy a Federal statute or regulation that requires you to have a social security number in order to receive a Federally-funded benefit to which you have otherwise established entitlement and you reside either in or outside the U.S.;

    The means-testing provision of H.R. 5140, the Economic Stimulus Act of 2008 is stated in SEC. 6428 (d) Limitation Based on Adjusted Gross Income.

    The federal government has also defined H.R. 5140 as a form of financial relief to persons who fall within certain income categories. According to a Whitehouse publication explaining the means-testing provision of H.R. 5140, "This relief would be available to everyone with adjusted gross income less than $75,000 for singles and $150,000 for married couples filing jointly. It will be phased out for taxpayers above those income thresholds. Taxpayers may qualify by filing a tax return for 2007 and including a valid Social Security number on their tax return."     Lawmakers included the identification requirements to HR.5140 under the belief that all legal residents of the United States will hold Social Security numbers. Therefore, it is incumbent upon the Commissioner of Social Security to "take affirmative measures to assure that social security account numbers will, to the maximum extent practicable, be assigned to all members of appropriate groups or categories of individuals by assigning such numbers" [Section 205(c)(2)(B)(i)] and that all qualified individuals receive "financial relief" under H.R. 5140 according to the stated will and intention of the United States Congress and Senate (as described in the links above).

    ya in the end i may want to come back to US but you never know if we like it in Canada and my kid settles down there we may end up being there and forget about US :)
    For now im surely taking atleast 10 jobs from here.Still your end in mind is US. Ok when I have a job in US and waiting in retrogression, what is the adavantage of having canadian PR and moving there unless otherwise you get a jump in career.

    Just becos it is retrogressed and you have canadina PR, there is no advantage in moving to Canada.

    Hi all,
    Sorry to be asking again, but I needed some details on changing employers before Oct 1st.
    Here's the situation. I am currently on H4 and got my H1B approved this year through a consultancy with start date of Oct 1st 2007 (lucky to get through lottery).
    I only have a copy of the H1B approval notice.
    A few days back I got an offer for a full time position with another company (NOT a consultancy). And they are willing to do my H1B.
    I learned through this forum, that applying for a change of employer before Oct 1st with an approved H1B, is like getting a new H1B only i'm already counted against the cap for the fiscal year. And because it's considered "new" paystubs are not required. Hope I've got this much right.

    My questions are:
    1. Are all the documents required the same as when you apply for a new H1B ? Only you also have to add the approved H1B notice?
    2. Is it ok if a COPY of the H1B approval notice is sent? Consultancy had a verbal agreement with me that I should work for a year with them , but I don't think anything is on paper. Also they said they would only give me my H1B approval notice (original) once I was placed on a project with them.
    3. Does the job title have to be the same? Consultancy applied as Programmer Analyst, and the new company needs a Web Programmer/Server Administrator. Would that cause any issues?
    4. The new company plans to do premium processing, so if all goes well, can I start working with them as soon as the receipt notice comes in, or do I have to wait till I have the approval notice in hand?
    5. Can the consultancy cause any problems for me with respect to my H1B? Is there any way they can find out about this and revoke my H1B?

    If anyone has been through this and got their H1B approved with a different employer before the H1B start date, then please post your replies here. What were the hurdles , and what should I be wary of to ensure everything goes smoothly?

    I got 2 year EAD from NSC in August 2008.

    Wanted to apply for Advance Parole (second time).

    Is NSC issuing 2 year AP's ?

    Wondering if any body got Advance Parole for 2 years from NSC.

    Also, I appreciate if any one can share their experince about INFOPASS to get Advance Parole in case of emergency

    (if one did not apply for AP & need to travel urgently).

    Very sorry to hear this news. If you have EAD, please use AC21 portability after one more month (after six months of I-485 filing). If your employer gives you severence pay, use it as a pay for a month instead of accepting lumpsum.

    Hopefully your I-140 gets approved in the mean-time.

    Because of the country quota what you have said below is applicable to only people from India, because of the tremendous competition from Indian applicatants you would need the highest points , ms or phd, 5 years experience, employer sponsorship, and also relatives, but if you are from non Indian countries then you will easily get it because there is not much if any competition.

    For example people from India might need 90+ points to have any chance but people from other countries might need just 60 points to get in. This is not merit based system, it is Kennedy Diversity Visa disguised as merit system.


    I have one question regarding your view. Actually point system gives points to the US experience and employer sponsorship. Because of limited number of greencards Those who are not having both of this may not be able to get green card. If you give your calculation everyone will get clear about. I think MS with 5 year US experience will get more points than fresh Phd. That serves the purpose. If that is the case then only eligible people will get gc.

    You definitely raise an interesting case. What I would say to that is that they just have to reevaluate the points allocation system. the details of the point allocation system may be bad but the overall intent still stands to benefit the highly educated while including the EB system as well will make sure less skilled but in demand people are also taken care off. handling family based GC is a whole diff ball game though.

    I have got an RFE for 485 application. USCIS is asking me for Employment Letter, Paystubs and W2 for the employer I NEVER worked. (I have typed exact message below)

    This is my situation-
    I worked for 'Employer #1' from Jan-2000 to Jan-2005
    Then I started working with 'Employer #2' from Jan-2005 to present. Employer #2 filed my H1/Labor/140/485. I am still working for Employer #2

    However, I thought of changing job in 2006 and 'Employer X' offered me a job and sponsored my H1 and it got approved too, but I changed my mind and decided to continue with my current employer (Employer #2) and I am still with Employer #2. Please note my latest H1B was sponsored by “Employer X”, but I never worked for this Employer.

    Please advice-
    1) What should I send to USCIS? As I don’t have (can’t get) Employment Letter, Paystubs and W2 for “Employer X”
    2) Would you consider this as simple case or complicated?
    3) Should I hire attorney? (I self filed my 485 in July-2007)

    Ask your attorney to write a letter in response to RFE and explaining the situation you never took the job with employer X though the H1B transfer or new is approved, this will clear the query of USCIS. One catch, you should have maintained a continuous employment with #2 and demonstrate the same to USCIS. Good luck!

    Note H1 to L1, H4 to H1, L1 to H1 is completely different, it is change of status - H1 to H1 is not change of status, so there is no question that you recent h1 is valid and past is invalid. Get an attorney, Good weekend

    There are several benefits to media coverage.

    You create awareness and build alliances.
    You give the other party (in this case congress) an opportunity to correct the problem.
    You get reporters to do additional investigate work that may help you build a case (This has already happened).
    You have an opportunity to correct public misconceptions, such as that all ITIN filers are illegal aliens, and thereby reduce the chance that the public will support such action in the future.


    Wikipedia also has good interpretation of rebate and ITIN. It clearly mentions

    "Taxpayers who filed their returns jointly are not eligible for payment if any of the persons on the tax return filed with an Individual Taxpayer Identification Number (ITIN) instead of a social security number.[4] For example, if a family of five had one parent with an ITIN, no money is payable to any member of the family, including US citizens with valid social security numbers.[7] As a result, many legal resident aliens and overseas military families will not receive any payment. US citizens who will not receive payments include those who have a parent or spouse who is not a citizen and who does not qualify for a social security number (not authorized to work in the United States). [8] US citizens may amend their tax returns to file separately, but in most cases this results in a lower deduction for dependents, thereby canceling any benefit from the stimulus payment. In many cases, it is better to forgo the stimulus payment than to file an amended tax return.[9] At least one million legal residents and tens of thousands of troops were affected by the law, which was designed to keep illegal immigrants from getting stimulus checks. [10]"

    Wikipedia understands situation better than some of the lawmakers.

    Dear Miss/Mr "JisDesh.....",

    Only time people came here in masses were when H-1B program existed and quota was very high. So you reminiscing about your uncle and aunt(when H-1B never existed), and now talking about "masses" makes no sense. So don't make a U-turn on your chosen path.Now quota has reduced and hence the struggle for H-1B visas.

    And who is talking about H-1B visas here, yes they are a privilege and not a right. iv is meant for people who have been sidelined due to unfair laws governing issual of GC's.It doesn't have anything to do with H-1B visa program and desi comapanies who misuse it.

    Go get a clear mind first

    I just said i miss those good old days before coming to america was possible for masses. There is value as long as it is limited.
    I did not look down up SW industry but loath these cheap desi companies who really raped this H1 visa program and the people standing on the streets of washington are the byproducts of that rape.There simply are not enough visa numbers. To increase them or not is that country's soverign right.And what rights are you talking about.A Visa is a privelege not a right.
